Terms of Service

By purchasing a dataset snapshot, subscribing to the hosted API, or accessing The Beauty API dataset or service, you agree to the following terms.

1. License Grant

Subject to payment, The Beauty API grants you a non-exclusive, non-transferable, worldwide commercial license to use the dataset and any data retrieved through the hosted API (the “Data”) for any lawful internal or commercial purpose, subject to Sections 2 and 3.

Hosted API data. Data you retrieve through the hosted API may be displayed to your end users and stored inside your own application database. When your subscription ends, expires, or is suspended, your access to the API infrastructure, live image hosting, and all future data updates will be immediately revoked. A permanent, offline copy of the catalog is licensed only through a dataset purchase.

If any payment is disputed, charged back, or falls into arrears, this license is immediately suspended until the balance is resolved.

2. Strict Restrictions

To protect the integrity of our product, you strictly agree NOT to:

  • Redistribute, sublicense, or resell the raw dataset files (CSV, JSONL, SQLite, or Image archives) to any third party.
  • Create a competing “Data-as-a-Service” or API product that serves the Data, whether taken from the dataset files or retrieved through the hosted API.
  • Redistribute the catalog from Data retrieved through the hosted API, or resell, package, or expose that Data as a competing data feed, standalone database, or public API.
  • Publicly host the raw database in a way that allows others to download the full archive.
  • Use any automated script, bot, or scraper to extract data from our hosted API outside of normal, authorized application limits, or to assemble a copy of the catalog.
  • Share your API access tokens or account login information with unauthorized third parties.

3. Intellectual Property and Third-Party Content

The Beauty API retains all rights it holds in the compiled database, API infrastructure, and data schemas, to the extent protected by applicable law; these Terms do not claim ownership of underlying facts. However, certain elements of the data, specifically product images, are the property of third parties (“Third-Party Content”).

These Terms do not grant you any ownership rights or intellectual property licenses to Third-Party Content. You represent and warrant that your use of the Data, including the public display of product images in consumer applications, will not infringe upon the intellectual property rights of any Third-Party Content owner. If your specific use case requires explicit rights to Third-Party Content, you are solely responsible for obtaining such permissions directly from the respective copyright owners.

4. Disclaimers and Limitations of Liability

4.1 “As-Is” Provision

The Beauty API is providing the use of the service and any accompanying Data on an “as is” basis and it expressly disclaims any and all representations and warranties, whether express or implied to the condition, value or quality of the service or any accompanying Data, including, without limitation, any warranties of merchantability, suitability or fitness for a particular purpose, non-infringement, security, accuracy, or any defect therein, warranties arising from a course of dealing, usage or trade practice. The Beauty API further expressly disclaims any representations or warranties that the use of the service will be continuous, uninterrupted or error-free, or that any information contained therein will be accurate or complete.

4.2 Limitation of Liability

In no event will The Beauty API be liable under these Terms for any consequential, special, indirect or punitive damages or for any loss, profits or revenue (whether in contract, tort, negligence or any other legal theory) in any way relating to these Terms (“Event”), even if The Beauty API had been informed in advance of the possibility of such damages. The Beauty API’s aggregated liability under these Terms for any claim or damage or series of such is limited to the amount of fees actually received by The Beauty API from you under these Terms during the one month period prior to the Event.

4.3 Medical and Health Information Disclaimer

The ingredient data, safety ratings (including comedogenicity and irritancy scores), and functional categorizations provided by The Beauty API are strictly for informational, educational, and developmental purposes. This Data is not intended to be a substitute for professional medical advice, diagnosis, or treatment, nor does it constitute dermatological or therapeutic advice.

4.4 Product Recommendations and Algorithms

Any product recommendations, compatibility scores, or ingredient suggestions built using our Data are inherently algorithmic. They are based on generalized research patterns and do not account for individual allergies, medical conditions, or skin sensitivities. The Data does not guarantee the safety, efficacy, or suitability of any cosmetic formulation for any specific individual.

4.5 Allergen and Safety Detection Limitations

While our database incorporates quantitative safety ratings, The Beauty API makes no guarantee regarding the complete detection of all potential allergens, irritants, or harmful ingredients. Furthermore, the Data cannot accurately predict or identify cross-reactivity between combined ingredients. End-users of applications built using our Data assume all risks associated with using physical skincare products.

5. Indemnification

You will defend The Beauty API against any claim, demand, suit or proceeding made or brought against The Beauty API by a third party alleging that your use of the Data or Service infringes or misappropriates such third party’s intellectual property rights, breaches applicable privacy laws or any other applicable law, or causes damage to such third party (a “Claim Against The Beauty API”). This includes any claims arising from adverse health effects experienced by end-users relying on recommendations powered by our Data, or your failure to adequately disclose medical disclaimers to your end-users.

You will indemnify The Beauty API from any direct damages, attorney fees and costs finally awarded against The Beauty API as a result of, or for any amounts paid by The Beauty API under a court-approved settlement of, a Claim Against The Beauty API, provided The Beauty API (a) promptly gives you written notice of the Claim Against The Beauty API, (b) gives you sole control of the defense and settlement of the Claim Against The Beauty API (except that you may not settle any Claim against The Beauty API unless it unconditionally releases The Beauty API of all liability), (c) gives you all reasonable assistance, at your expense, and (d) The Beauty API shall not negotiate or enter into any settlement for this matter without your prior written consent.

6. Payments & Refunds

Due to the digital nature of the product (instant download of about 20GB of data), all sales of the dataset are final. Similarly, all hosted API subscription fees are non-refundable and will not be prorated for partial months of service. We provide a 1000-product sample pack to ensure the format meets your technical requirements before purchase.

7. Updates & Refreshes

A one-time purchase of The Complete Archive licenses the static snapshot of the Data available at the time of purchase. Future updates, data refreshes, or barcode enrichments are not automatically included. Licensees may request a data refresh, which will be billed separately based on the volume of updated data points. Access to real-time, continuously updated data requires an active subscription to our hosted API service.

8. Governing Law

These terms are governed by the laws of the Republic of Singapore. Any disputes shall be resolved in the courts of Singapore.

9. Modifications to Terms

The Beauty API reserves the right to update or modify these Terms at any time, at its sole discretion, with or without notice to you. Any such modification will be effective immediately upon public posting on our website. Your continued use of the Data or API following any such modification constitutes your acceptance of the new Terms.

10. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining Terms shall otherwise remain in full force and effect.

11. Assignment

You may not assign, delegate, or transfer these Terms or your rights or obligations hereunder, in whole or in part, without the prior written consent of The Beauty API. The Beauty API may assign, transfer, or delegate these Terms and any of its rights and obligations hereunder without your consent, including to an affiliate or in connection with a merger, acquisition, corporate reorganization, or incorporation of a new entity (e.g., transitioning to a Private Limited company). Upon such assignment, the new entity shall assume all rights and obligations of The Beauty API under these Terms.

12. API Request Logs and Aggregated Usage Insights

The Beauty API logs requests made to the hosted API, including the endpoint called, the identifiers of the products or ingredients requested, search terms and filters, the API key used, the response status, and the time of the request. We use these logs for billing, security, capacity planning, and service improvement.

You agree that The Beauty API may combine request logs across all customers into anonymised, aggregated statistics (“Aggregated Usage Insights”), such as which products, brands, ingredients, or search terms are most frequently requested, and may use, publish, license, or sell Aggregated Usage Insights to third parties, including brands, manufacturers, and retailers.

Aggregated Usage Insights will never identify you, your organisation, your account, your API keys, your end-users, or any individual request, and The Beauty API will not disclose your individual query history or per-account usage to any third party except as required by law. You may opt out of inclusion in Aggregated Usage Insights as described in our Privacy Policy.

13. Promotional Rights

The Beauty API may use your name and/or logo in promotional materials and on The Beauty API’s website.
