Terms of Service

1. License Grant

Subject to payment, The Beauty API grants you a non-exclusive, non-transferable, worldwide commercial license to use the dataset (the “Data”) for:

• Powering e-commerce storefronts and mobile applications.
• Internal Research & Development (R&D).
• Training machine learning and AI models.

2. Strict Restrictions

To protect the integrity of our product, you strictly agree NOT to:

• Redistribute, sublicense, or resell the raw dataset files (CSV, JSONL, SQLite, or Image archives) to any third party.
• Create a competing “Data-as-a-Service” or API product that serves the raw data provided in this bundle.
• Publicly host the raw database in a way that allows others to download the full archive.
• Use any automated script, bot, or scraper to extract data from our hosted API outside of normal, authorized application limits.
• Share your API access tokens or account login information with unauthorized third parties.

3. Intellectual Property and Third-Party Content

The Beauty API retains all right, title, and interest in the compiled database, API infrastructure, and data schemas. However, certain elements of the data, specifically product images and brand descriptions, are the property of third parties (“Third-Party Content”).

These Terms do not grant you any ownership rights or intellectual property licenses to Third-Party Content. You represent and warrant that your use of the Data, including the public display of product images in consumer applications, will not infringe upon the intellectual property rights of any Third-Party Content owner. If your specific use case requires explicit rights to Third-Party Content, you are solely responsible for obtaining such permissions directly from the respective copyright owners.

5. Indemnification

By using The Beauty API dataset to power public-facing applications, storefronts, or tools, you assume full responsibility for how the Data is presented to your end-users. You agree to indemnify, defend, and hold harmless The Beauty API (and its founders, officers, and agents) from and against any and all claims, liabilities, damages, losses, or legal expenses arising out of:

• Any adverse health effects, allergic reactions, or skin damage experienced by end-users relying on recommendations powered by our Data.
• Your failure to adequately disclose medical disclaimers to your end-users.
• Any claim that your specific use, display, or distribution of Third-Party Content (including product images) infringes upon the copyrights, trademarks, or intellectual property rights of any third party.
• Any violation of these Terms by you or your organization.

6. Payments & Refunds

Due to the digital nature of the product (instant download of 20GB+ of data), all sales are final. We provide a 1000-product sample pack to ensure the format meets your technical requirements before purchase.

7. Updates & Refreshes

A standard license covers the current snapshot of the Data. Subsequent major version updates may require a “refresh” fee at a discounted rate for existing licensees.

8. Governing Law

These terms are governed by the laws of the Republic of Singapore. Any disputes shall be resolved in the courts of Singapore.

9. Modifications to Terms

The Beauty API reserves the right to update or modify these Terms at any time. We will notify users of any material changes by updating the “Last Updated” date at the top of this document or via email. Your continued use of the Data or API after any changes indicates your acceptance of the new Terms.

10. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining Terms shall otherwise remain in full force and effect.
